GENERAL TERMS AND CONDITIONS OF BUSINESS

SCOPE
These General Terms and Conditions regulate the use of the web shop (hereinafter "web shop" or "website") of Oliente AG (hereinafter "Oliente") and the conditions of sale of the products offered in the web shop.

By using the web shop, you agree to accept the general terms and conditions without reservation. Consent is given by accessing and using the website. Please therefore read these terms and conditions carefully before using the web shop.

ACCESS TO THE WEBSITE
Your visit to the website and the use of the information and offers provided therein is at your own risk and responsibility.

Oliente is entitled to restrict access to the website, partially or completely, at any time and at its sole discretion. Oliente does not guarantee full and constant access to the website and declines all liability if the website is not accessible or only partially accessible for any reason.

YOUR ACCOUNT
When you use the Oliente web shop, you are responsible for keeping your account details (username and password) safe and for restricting access to the computer you use to use the web shop. We ask you to inform us immediately if you suspect that an unauthorized third party has gained knowledge of your account details or if you are concerned that a third party has gained unauthorized access to your account details or your account. You also guarantee that the data you provide to Oliente for use of the web shop is correct and complete and that you keep it up to date at all times.

Oliente reserves the right to restrict or block your access to the web shop and to close your account if you violate legal provisions, these Terms and Conditions or the terms of use of the loyalty card.

MINORS
The products offered in the web shop can only be purchased by adults. If you are under 18 years old, you may only use the web shop to purchase products with the assistance of a parent or guardian.

COMMUNICATION WITH OLIENTE
By using the web shop or sending emails to Oliente, you are communicating with us electronically. You agree that Oliente may communicate with you electronically for contractual purposes and may send you all consents, notifications or other communications electronically, unless mandatory legal provisions stipulate special formal requirements.

CONCLUSION OF THE CONTRACT
The presentation of products in the online shop is not a legally binding application, but represents a non-binding online catalog. If you simply place products in the shopping cart, this does not count as a binding order. You only place a binding order for the products in the shopping cart when you click the "Pay now" button on the order page. Confirmation of receipt of this order is sent immediately by automated email and does not constitute acceptance of the contract. We will then check your order and the availability of the ordered products. The order is accepted by sending the delivery confirmation by email, which is sent together with the shipment of the goods. The purchase contract is concluded with this delivery confirmation or the delivery of the goods within five days.

INFORMATION ABOUT PRICES AND PRODUCTS
Oliente provides the information published on the website solely for your personal use and for information purposes. Oliente may change this information at any time and without prior notice. Oliente makes no express or implied guarantee that the information published on the website is correct, complete or up-to-date. The prices indicated for the products are net prices including VAT but excluding shipping costs.

SHIPPING COSTS


For orders placed up to a net order value of CHF 99.99, Oliente will charge you a shipping fee of CHF 7.50 per package. For orders over CHF 100 (after deduction of any discounts), delivery is free of charge.



MINIMUM ORDER VALUE ORDER QUANTITIES
The minimum order value is CHF 29.90 (after deduction of any discounts, excluding shipping costs). Please also note that Oliente only sells the products available in the web shop to you in normal household quantities and for personal use (max. 6 pieces of the same product). Your order to Oliente AG is transmitted in encrypted form (SSL certificate) so that third parties do not have access to the transmitted data.

PRODUCT AVAILABILITY
You can see the availability of the products on the respective product page. We mark the products with the following colors:

Green: Available immediately
Red: The product is currently out of stock
Products with the status green will be prepared and shipped within 48 hours. Products with the status red are currently not available in our warehouse and therefore cannot be added to the shopping cart.

PAYMENT

At Oliente you have various payment options available.

Payment with Twint:
You can also pay for your order quickly and securely using the TWINT app on your computer or smartphone.

TWINT on your smartphone:
Select the TWINT payment option during the ordering process. As soon as the payment process has been initiated, the TWINT app will automatically open on your smartphone and the payment can be confirmed.

TWINT on the computer:
Select the TWINT payment option during the ordering process. As soon as the payment process has been initiated, a QR code will be displayed on the screen. Now open the TWINT app and scan the QR code. The payment can now be confirmed.

Please note that TWINT never asks for personal or financial information without being asked. If you do not have a TWINT account, you can create one in just a few steps on the TWINT website

Payment by credit card:
The order value and any shipping costs are reserved/blocked on your credit card at the time of ordering. The total price is only charged to your credit card when the products are shipped. Your credit card details are transmitted using an encrypted SSL procedure. This high security standard ensures that your purchase at Oliente is safe.

Payment by payment slip:
Oliente grants you a payment period of 30 days (net) from the date of invoice to pay the total price (without unilateral deductions [discount]) by payment slip. In the event of late payment, Oliente will charge a reminder fee of CHF XXXX. on the total price. In addition, Oliente is entitled to charge default interest of 5% on the total price from the date of late payment.

DELIVERY

We work with the Swiss Post to ship the ordered products. We only deliver to addresses in Switzerland and the Principality of Liechtenstein. After we have packed your shipment, you will receive an email from us with a link that you can use to find out about the status of the delivery and the delivery date.

Oliente endeavours to dispatch the products you have ordered within two working days of receiving your order. Despite our best efforts, we cannot rule out seasonal delays due to high order volumes (e.g. Christmas).

RIGHT OF WITHDRAWAL

Oliente AG grants the customer a voluntary 14-day right of withdrawal. The customer is entitled to withdraw his declaration of intent to conclude the contract without giving reasons within 14 days of receipt of the goods in text form (e.g. letter, email, fax) or by returning the unopened goods. Exercising the right of withdrawal will result in the purchase contract being converted into a reversal relationship, whereby the services received under the purchase contract must be refunded. In the event of a withdrawal, please return the goods to us immediately in the original packaging.

You are responsible for the burden of proof and the costs of returning the goods. We will refund the purchase price immediately after receipt of the goods. We reserve the right to deduct costs for possible damage or excessive wear from the purchase price to be refunded.

Please note that we do not grant a right of cancellation for the following products: Gift sets, reduced items or opened items are excluded from cancellation/exchange. Obligations to refund payments must be fulfilled within 30 days. For you, the period begins when you send your cancellation notice or the delivered goods, and for us when we receive them.

If there is no right of cancellation, you will have to bear the costs of returning and re-sending the goods. For all other defects in the products that are not transport damage, the statutory warranty rules apply. Instead of demanding a change or a reduction in price, you instead allow Oliente to immediately replace defective products with defect-free ones.

RISK AND RESERVATION OF TITLE

Benefit and risk with regard to the ordered products pass to you when they are handed over for shipment to the Swiss Post of Oliente.

The products delivered remain the property of Oliente until full payment has been made. You agree that Oliente is entitled to have the ordered products registered in the retention of title register of your place of residence.

RIGHT OF RETURN, TRANSPORT DAMAGES AND WARRANTY

You undertake to check the delivery immediately for completeness, accuracy and integrity. You must report any complaints about the delivery or individual products to Oliente as soon as possible (but no later than 7 calendar days after receipt of the delivery).

Delivered products that do not match your order will be exchanged immediately by Oliente. Please understand that Oliente can only exchange packaged and undamaged products. Gift sets, discounted items or opened items cannot be exchanged. Oliente will bear the return costs for incorrectly delivered products.

If the products you ordered have been damaged during transport, Oliente will, at its discretion, provide you with a replacement free of charge. We ask that you return any products damaged during transport to Oliente and inform Oliente in writing of the damage. Oliente will bear the return costs for products that are proven to have been damaged during shipping.

For all other defects in the products (non-transport damage), the statutory warranty rules apply. Instead of demanding a change of contract or a reduction in price, you instead allow Oliente to immediately replace defective products with defect-free ones.

LIABILITY AND LIMITATION OF LIABILITY

Oliente's liability is limited to the minimum permitted by law. This means in particular that Oliente completely rejects liability for indirect and consequential damages (e.g. compensation for consequential damages and financial losses, lost profits, loss of interest). Oliente accepts no liability for non-contractual damages. Oliente also excludes liability for gross negligence and unlawful intent for persons employed by Oliente.

SECURITY

Oliente takes reasonable precautions and uses appropriate security technologies to protect your data and information you send to us. You are responsible for providing, maintaining and updating the software on the computer you use to access the website. You agree to keep the software you use up to date, for example by downloading updates, and to install an anti-virus program on your computer and keep it updated at all times.

DATA PROTECTION

We take the protection of your data seriously. The data protection regulations are the subject of a separate declaration.

EVALUATION OF PRODUCTS

After purchasing a product in our webshop, you have the opportunity to rate the product. Reviews and comments that contain inappropriate, defamatory, discrediting, racist, offensive, threatening or obscene content or that otherwise violate the rights of third parties will be removed by Oliente immediately and at its own discretion.

INTELLECTUAL PROPERTY RIGHTS OF OLIENTE AND BUSINESS PARTNERS

The design and the entire content of the website (text, images, graphics, etc.) represent the intellectual property rights of Oliente or our business partners, which are legally protected by the relevant laws (such as copyright or trademark law). When you access the website, you agree to respect our intellectual property rights and those of our business partners. The (partial or complete) reproduction, modification or other use and use of the website or the content published on it is only permitted for informational purposes or for personal use. You may only save or print out content from the website if the source is fully cited.

CHANGES TO THE TERMS OF USE

Oliente reserves the right to modify the terms of use and sale of the web store at any time.

APPLICABLE LAW / JURISDICTION

Rights and obligations arising from this agreement are subject to Swiss substantive law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of performance is Poststrasse 24, 6300 Zug, Canton Zug. The place of jurisdiction is the registered office of Oliente; Oliente has the right, however, to bring the dispute before any other court that would normally have jurisdiction over you in the absence of an agreement on the above-mentioned place of jurisdiction.
